GEMME at the General Assembly of the European Law Institute 2025

GEMME had the honour of participating in the General Assembly of the European Law Institute (ELI), held in Vienna from 22 to 24 September 2024. This major event brought together lawyers, magistrates, academics and experts from across Europe to discuss the major legal challenges of our time.

High-quality round tables

The round tables organised during this assembly were unanimously praised for the quality of the presentations and the richness of the discussions. Among the topics discussed were the creation and governance of corporate foundations, the digitisation of justice, the transfer of digital assets, and the challenges posed by climate change. The latter topic offers prospects for mediation and amicable settlement methods in general as effective tools for preventing and resolving emerging environmental disputes, both at national and European level.

A reference report that is still relevant today

This meeting was an opportunity to highlight the high quality of the 2018 ELI-ENCJ report on the relationship between formal and informal justice, and on the relationship between courts and alternative dispute resolution (ADR) methods. This document, which is still highly relevant today, provides essential guidelines for promoting the use of mediation and ADR in the handling of emerging disputes. It proposes European best practices and offers concrete recommendations to ensure consistent and effective access to justice, while preserving the fundamental rights of litigants.
